This Equipment Rental Agreement applies to equipment rental transactions made through WorkRent.
The equipment owner or provider is referred to as the "Owner" and the person renting the equipment is referred to as the "Renter."
WorkRent provides technology that allows Owners and Renters to find one another, communicate, and facilitate transactions.
Unless expressly stated otherwise, WorkRent is not the owner, manufacturer, dealer, lessor, operator, maintainer, or insurer of equipment listed by users.
The Owner must provide an accurate description of the equipment, including known defects, restrictions, condition, accessories, and other material facts.
The Renter is responsible for inspecting equipment before use and should not use equipment that appears damaged, defective, unsafe, incomplete, or unsuitable.
The Renter agrees to use equipment only:
The Renter may not:
The rental begins and ends according to the dates and times agreed through WorkRent.
Late returns may result in additional charges.
The Renter agrees to pay the rental rate, deposits, fees, taxes, delivery fees, late fees, damage charges, or other amounts shown and approved for the transaction.
Owners and Renters are encouraged to photograph equipment before and after the rental.
Photos, messages, transaction records, and inspection documentation may be used to evaluate disputes.
To the extent permitted by applicable law and the specific transaction terms, the Renter may be financially responsible for loss, theft, misuse, abnormal damage, missing accessories, or failure to return equipment.
Normal wear and tear should not be treated as misuse or damage.
The Owner is responsible for providing equipment in a condition reasonably suitable for the intended rental use.
Unless expressly agreed otherwise, the Renter should not perform repairs or maintenance beyond normal operating procedures without the Owner's permission.
The Renter is responsible for using appropriate personal protective equipment and following reasonable safety precautions.
Where equipment must be transported, the party responsible for pickup, delivery, loading, unloading, towing, securing, or transportation must do so lawfully and safely.
The Renter is responsible for determining whether operating particular equipment requires a driver's license, commercial license, certification, training, insurance, permit, or other legal authorization.
WorkRent does not represent that equipment, Owners, or Renters are insured unless a specific WorkRent feature expressly states otherwise.
Users should maintain any insurance appropriate for their activities.
Accidents, theft, significant damage, or injuries involving rented equipment should be reported promptly to appropriate emergency services, law enforcement, the Owner, and WorkRent when appropriate.
WorkRent does not independently inspect every item listed on the platform and does not guarantee the safety, mechanical condition, legal compliance, maintenance history, or suitability of user-listed equipment.
WorkRent may review photos, communications, payment records, rental records, inspection records, and other relevant evidence when assisting users with a dispute.
All rentals are also subject to the WorkRent Terms of Service and Privacy Policy.
